Terms of Service

• Account Creation: To access the computing, coding, and containerized features of the Service, you must register and create an account.
• Federated Single Sign-On (OAuth): To enforce data minimization and platform security, the Service utilizes third-party identity management providers (including Google, GitHub, GitLab, BitBucket, and Apple ID). You agree to maintain the security of your third-party account credentials. You are entirely responsible for all activities that occur under your account session.
• Anonymity and Verification: While you may utilize anonymous, generic, or team-based email configurations for account management and verification, you warrant that all information provided to the Service via federated identity providers is valid, clear, and does not violate any third-party rights.

• Isolated Environments: The Service allocates dynamic, containerized execution sandboxes and decoupled processing environments for your running code. Compute resources are provided on an on-demand, variable configuration basis and are subject to runtime allocation limits, memory caps, and automated operational timeouts enforced by our backend infrastructure.
• Your Content and Code: You retain all ownership rights to the scripts, notebooks, environment variables, datasets, and execution outputs that you directly write, execute, compile, or upload within your active workspaces (collectively, “User Content”).
• License to Host: You grant us a worldwide, non-exclusive, royalty-free, fully paid license to host, parse, execute, transmit, and display your User Content strictly for the purpose of providing, maintaining, and troubleshooting the Service for you or your Organization.
• Persistent Directories: Persistent file storage maps are provided to isolate and preserve your files across distinct browser sessions. However, persistent storage volumes attached to dormant, unpaid, or abandoned account allocations may be permanently deleted in accordance with our data retention cycles.

You agree not to misuse the compute infrastructure provided by the Service. Specifically, you shall not use the Service to:

• Conduct cryptocurrency mining, distributed denial-of-service (DDoS) attacks, or automated scanning, fuzzing, and penetration testing of external networks.
• Bypass, disable, or alter inbound load balancing constraints, web application firewalls, or outbound proxy server configurations.
• Host, execute, or distribute malicious code, ransomware, viruses, worms, or software designed to disrupt our private network subnets or remote infrastructure.
• Attempt unauthorized cross-tenant data access, security perimeter escalation, or container escape activities to view other users' isolated file directories or compute instances.
• Violate any applicable local, national, or international laws, including export control regulations concerning data and software utilities.

We reserve the immediate right to suspend, throttle, or permanently terminate your access to our compute resources without prior notice if we detect usage behavior that compromises the stability, physical security, or performance of our platform architecture.

• Merchant of Record: All subscription management, order checkout tracking, recurring billing tokenizations, invoicing, and localized currency conversions are processed entirely by Paddle, acting as our external Merchant of Record (MoR).
• Billing and Taxes: By subscribing to a paid tier of the Service, you agree to pay the fees specified during checkout. Because Paddle acts as the legal reseller of our platform licensing, they manage local transaction mechanics, fraud mitigations, and cross-border tax compliance (such as EU/UK VAT or local sales tax assessment). All financial disputes or billing discrepancies must be addressed directly with Paddle.
• Cancellations and Refunds: Subscription cancellation terms are governed by the checkout protocols handled via the MoR. Upon cancellation, your account will remain active until the end of your current paid billing cycle, after which your compute tier will downgrade to standard resource parameters.

• AS IS Basis: THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
• No Guarantee of Continuous Uptime: WE DO NOT GUARANTEE THAT COMPUTE INSTANCES, PERSISTENT FILESYSTEM DIRECTORIES, OR WEB SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR COMPLETELY ERROR-FREE, OR THAT CODE OUTPUT DATA WILL NOT BE SUBJECT TO UNEXPECTED TERMINATION DURING SUDDEN RUNTIME INSTANCE CHANGES.
• Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS FOUNDERS, OR ITS INFRASTRUCTURE SUPPLIERS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, DATA CORRUPTION, WORKSPACE PERMANENT LOSS, OR PROPERTY FAILURE, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE.
